The Child in Conflict with the Law – the Evolution of Guardianship Practice and Formal-Legal Regulations and its Implications for Modern Rehabilitation of Minors

Abstract

The purpose of the article is to present the issue of the child in conflict with the law in the light of the evolution of the practice of re-socialization and the analysis of normative regulations in Poland. The institutional protection of the child in conflict with the law is shaped by the historical development of care and educational institutions and juvenile justice. The main research problem is the question of the ways of treating a child in conflict with the law. These ways are determined by legal regulations and determined by the historical context of socio-cultural and political changes over more than two centuries. Reflection on the perspectives of capturing the child in conflict with the law allows us to ask the question about the contemporary approach to the juvenile in the Juvenile Support and Rehabilitation Law of 2022, which is intended to be an effective instrument for protecting the child from demoralization and the commission of criminal acts. The article is based on an analysis of legal regulations and pedagogical and legal literature with a particular focus on the area of juvenile law.
