The Restrictions on the Implementation of the Right of Persons Detained on Remand to Visits and the Issues of Freedom of Conscience and Religion

Abstract

The issues of freedom of conscience and religion of pre-trial detainees regulated in the Executive Penal Code are essentially consistent with the provisions concerning convicted persons. The restrictions resulting mainly from the need to preserve the good of criminal proceedings may be introduced on the basis of orders of the disposing authority and, exceptionally, the director of the detention centre. The restrictions on contacts with clergy were included in the provision on visits with persons detained on remand instead of in a separate provision. Moreover, the interference of the disposing authority regarding the manner and type of contacts between detaines and clergy may violate the rights related to freedom of conscience and religion.
