The Problem of the Invalidity of Marriage Due to a Grave Defect of Discretion (Can. 1095, 2° CIC) in the Roman Rota Sentence by c. Ferreira Pena on 6 December 2017

Abstract

The study analyzes the sentence issued by the Tribunal of the Roman Rota, authored by c. Ferreira on December 6, 2017. It is divided into two parts: the first part addresses the case for the nullity of marriage based on a separate lack of legal discernment (can. 1095, 2° CIC) and the incapacity to assume the essential obligations of marriage due to psychological reasons (can. 1095, 3° CIC). The second part discusses the exclusion of the indissolubility of marriage (can. 1101 § 2 CIC) as presented in the same Roman Rota sentence.
