Ecclesiological Motives Behind the Choice of the Code as a Source of Law in the Church

Abstract

The study deals with problems related to the codification of canon law. The author focuses his attention on the legal and ecclesiological reasons for choosing the code. It points to the model of the Church after Vatican I and the legal tradition of the Church, which influence the choice of the code but at the same time determine its essence and content. Showing the reasons for choosing the code in the historical context is important for today’s considerations surrounding the Code of Canon Law as the right choice of legislative activity in the Church.
