This study examines the injured party’s role in the occurrence or escalation of damage under Article 362 of the Polish Civil Code. It evaluates the court's discretion in determining the extent to which compensation may be reduced based on the injured party’s actions that contribute to the harm. The author discusses three primary theoretical frameworks that influence the interpretation of this provision: causam concurrentem (causal contribution), the theory of objective wrongfulness, and culpa concurrens (fault-based contribution). The author concludes that, although courts have considerable discretion, their rulings must remain predictable and adhere to the principles of proportionality, fairness, and established legal doctrine.
