Sale of Sacred Items Under the CISG

Abstract

This study explores legal restrictions on the circulation of sacred goods under state law (monument protection) and canon law (prohibition of relic sales). Contracts involving sacred items risk being declared invalid due to conflicts with legal norms or principles of social order. The circulation of such goods occurs at the intersection of state and canon law, highlighting tensions between these legal systems. The research concludes that CISG can apply to transactions involving sacred items, excluding relics and requiring adjustments to legal remedies. Traditional civil law institutions, such as price reduction and damages, rely on goods valuation, complicating their application to items of sacred significance.
