Etsi legislator non daretur: In Search for the Adequate Concept of Canon Law

Abstract

The research problem around which these analyzes focus, concerns the issue of the creation and validity of law without the law-making activity of the legislator. A special research area is the canon law system in its historical aspect of evolution from the original and arbitrary forms of resolving controversies to positively established norms subsequently included in the law code. Considerations on the role of the legislator will also enable the reconstruction of the legal order of the Church in such areas as the ontology of law, the relationship between law and statute, or the originality of canon law in relation to secular legal orders.
