The Multidimensional Nature of Obedience to Church Teaching and Law in the Canonical Legal Order

Abstract

In the presented study, the author undertook a reflection on the phenomenon of obedience in the canonical legal order. Studying the regulations of the 1983 Code of Canon Law, he pointed out that this phenomenon has a multidimensional character. As a result of his analyses, he distinguished three forms of obedience: obedience of faith, religious obedience and obedience to canon law. In this context, he considered the problem of disobedience, denying such an attitude in the case of infallible doctrine; however, he did not exclude it in the case of further forms of obedience, namely religious obedience and obedience to canon law. In the first case, in his view, it could be generated by an erroneous teaching; in the second hypothesis by an improperly enacted law (an unintelligent or unjust law) and also by the inadequacy of the norm to the circumstances.
