Civilization of Canon Law and Its Constitutional Grounds

Abstract

Canon 22 of the Code of Canon Law is about for the mechanism of canonization of civil law, which is the application of state law to certain matters regulated by canon law. The author notes that the same mechanism can also occur in the opposite direction (state law referring to the norms of canon law), and calls it, in reverse, the civilization of canon law. To justify the occurrence of this phenomenon, the author presents several examples from Polish law, in which norms – sometimes explicitly and sometimes not – refer to various rules and requirements of canon law.  The author argues that the system of canon law is nothing more than the internal law of a voluntary association of persons, as mentioned in Article 12 of the Constitution.
