Register for YouTubers and Tiktokers. Obligation to Register Entities Providing On-demand Audiovisual Media Services

Abstract

The article discusses the issue of the obligation to register entities providing audiovisual media services on demand, as laid down in Article 47ca of the Polish Broadcasting Act. This obligation, introduced as a result of the implementation of Directive 2010/13/EU as amended by Directive 2018/1808, may apply not only to traditional nonlinear broadcasters but also to content creators publishing videos on platforms such as YouTube, TikTok, or others. The article analyzes the conditions under which an entity may be classified as a provider of an on-demand audiovisual media service, highlighting interpretative challenges and the risk of excessively broad application of the registration requirement to non-professional individuals. It also addresses the issue of assessing the current legal framework in light of constitutional principles such as proportionality, freedom of expression, and artistic freedom. The article concludes with a recommendation to clarify and interpret the relevant provisions in a way that limits the registration obligation to entities that genuinely operate in the media market and compete for audience attention with traditional media.
