Selected Comments on the Position of the Family Law Codification Commission on the Out-of-Court Dissolution of Marriage

Abstract

This article critically examines the Codification Commission of Family Law’s proposal to permit the dissolution of marriages before a civil registry officer rather than in court. Adopting a dogmatic legal approach, the author assesses whether this change is consistent with the constitutional and axiological principles underlying Polish family law. The author considers that removing divorce proceedings from judicial control would diminish marriage to a mere civil contract, thereby eroding safeguards for public and private interests.
