Transfer of Criminal Proceedings between Member States of the European Union

Abstract

This study aims to provide a preliminary assessment of the effectiveness, functionality and potential of transferring criminal proceedings between European Union member states. This constitutes a significant addition to existing cooperation mechanisms between member states. The study primarily uses legal analysis to interpret Regulation (EU) 2024/3011 on the transfer of criminal proceedings, taking into account the available literature on the subject and considering other instruments of cooperation in criminal matters. The results indicate that transferring proceedings is an important tool for increasing the flexibility and efficiency of the cooperation system.
