Estimated Fear and Total Simulation of Marriage Consent in the Judgment of the Roman Rota C. Salvatori of October 26, 2012

Abstract

The author presents and comments on the sentence of the Tribunal of the Roman Rota of October 26, 2012, issued in the third instance in the case of nullity of marriage brought on account of force and fear of the woman and the simulation of marriage consent in this woman (in the first instance, a positive sentence was passed on account of force and fear, in the second, the judgment was negative). The Tribunal of the Roman Rota passed a positive sentence (constare de nullitate) solely for force and fear. In proving the nullity of the marriage, the rotating camp took into account both the woman aversion to the man and the coercive measures applied to the woman by her parents.
